Welcome to ABCcount. Please read these Terms of Service, End User License Agreement, and Acceptable Use Policy ("Agreement") carefully before using our website and services. By accessing or using ABCcount, you agree to be bound by this Agreement. If you do not agree to all of these terms, do not use our website or services.

PART I: Terms of Service and End User License Agreement

1. Structure of services and grant of license

We provide both free and premium subscription-based online text utilities through ABCcount.

• Free services: We grant you a revocable, non-exclusive, non-transferable, limited license to use our basic tools (including the Word Counter and Word Scrambler) without creating an account or providing payment.
• Pro services: We grant registered, paying subscribers a limited, non-exclusive, non-transferable, revocable license to access advanced tools (including the Plagiarism Checker and AI writing analysis features) strictly for personal or internal business purposes.

2. User accounts and security

• Anonymity: Free tools may be used anonymously without registering an account.
• Registration: You must create an account to access Pro features.
• Account safety: Account authentication and database storage are securely handled by our third-party provider, Supabase. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

3. Subscriptions, fees, and billing

• Payment processing: All payments for ABCcount Pro are securely processed entirely through Stripe. We do not store, see, or collect your credit card number or raw financial credentials on our servers.
• Billing cycle: Subscription fees are billed on a recurring basis (monthly or annually) as selected at checkout.
• No refunds: All fees paid for ABCcount Pro are non-refundable. We do not offer prorated refunds, credits, or returns for partial subscription periods or unused features.
• Cancellations: You can cancel your subscription at any time through your account settings. Access to Pro features continues until the end of your current paid billing period. Canceling does not automatically delete your account.

4. Intellectual property and content ownership

• Your content: You retain all intellectual property rights, copyright, and full ownership of any text, data, or documents you paste, type, or upload into ABCcount.
• Limited license to us: By submitting text to our premium tools, you grant us and our technical third-party API providers a temporary, automated, worldwide license to parse, scramble, format, or analyze your text solely to return the requested results to you.
• Our infrastructure: All software, algorithms, user interfaces, logos, designs, and branding associated with ABCcount are the exclusive intellectual property of ABCcount and its licensors.

5. Disclaimers and limitations of liability

Third-party dependency: Because Pro features rely heavily on external APIs, machine learning models, and public databases (including Anthropic and Supabase), we do not guarantee 100% service uptime, nor do we guarantee the absolute accuracy, reliability, or completeness of plagiarism reports or AI text suggestions.

"As-is" service: All utilities are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied.

Limitation of liability: To the maximum extent permitted by law, ABCcount, its operators, and its affiliates shall not be liable for any professional, academic, financial, indirect, incidental, or consequential damages resulting from inaccurate analysis, missed plagiarism, tool downtime, system errors, or academic/professional penalties resulting from your use of our reports.

6. Governing law and dispute resolution

This agreement is governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal actions, disputes, or proceedings arising from or relating to this Agreement must be filed exclusively in the state or federal courts located within the State of Texas, and you consent to the personal jurisdiction of such courts.

PART II: Acceptable Use Policy

This Acceptable Use Policy ("AUP") defines the rules and restrictions governing your behavior when interacting with ABCcount's infrastructure, free utilities, and premium APIs.

7. Abuse of services and API prohibitions

You must not use ABCcount's systems to exploit, stress, or manipulate our underlying platform. Prohibited actions include, but are not limited to:

• Scraping and automation: Utilizing automated systems, scripts, bots, scrapers, crawlers, or spiders to extract text, bypass limits, or mass-submit content to our word counting, scrambler, or Pro analysis tools without our prior written authorization.
• API exploitation: Attempting to reverse engineer, intercept, or directly call our underlying Anthropic or Supabase API endpoints outside of the intended web user interface provided by ABCcount.
• Denial of service: Flooding our servers with excessive requests, attempting to overload our bandwidth, or executing any action that disrupts the availability of services for other users.
• Vulnerability scanning: Testing, scanning, or probing the vulnerabilities of our website, infrastructure, or network security protocols without explicit written consent.

8. Content restrictions

You are solely responsible for the text you input into ABCcount. You agree that you will not submit, upload, or process any text or files that:

• Infringe upon the intellectual property, copyright, patent, or trademark rights of any third party.
• Contain malicious code, viruses, malware, trojan horses, worms, or any code designed to disrupt or corrupt our technical utilities.
• Feature explicitly illegal, defamatory, threatening, abusive, harassing, or hate-speech materials.
• Violate the safety and terms of service guidelines established by our third-party API provider, Anthropic.

9. Enforcement and system monitoring

We reserve the right to monitor platform usage to ensure compliance with this AUP. If you are found to be violating these terms, we reserve the right to take immediate action without prior notice, including:

• Temporary or permanent suspension of your ABCcount account.
• IP address blocking to prevent access to both free and paid features.
• Forfeiture of any subscription fees paid (in alignment with our strict no-refund policy).
• Referral to law enforcement or legal counsel if your actions constitute criminal behavior or cause material infrastructure damage.

10. Changes to these terms

If these terms change meaningfully, we'll update the date at the top of this page.
